TERMS OF USE
GENERAL
Thanks for using Comtrade Mailing System (we'll refer to it as "Platform"). Please read these Terms of use carefully (we’ll refer to it as "Terms"). By using Platform or signing up for an account, you’re agreeing to these Terms. This is a legal agreement. If you do not accept or disagree with the Terms, please do not use the Platform. Comtrade Mailing System is email marketing software offered in the form of a web application and an accompanying API. It allows you to create, design, run and manage email marketing campaigns and surveys (we’ll refer to it as "Service"). Platform is owned and operated by Comtrade System Integration doo Beograd (we’ll refer to it as "Comtrade SI" or “Comtrade”). In addition to the general terms and conditions of Comtrade SI (Comtrade Website Terms of Use) available here, the following specific conditions apply. USER ACCOUNT
Eligibility
In order to use our Platform you must:
- be at least eighteen (18) years old
- complete the registration process
- agree to the Terms
- provide true, complete and up to date information.
Term
The Term begins when you sign up for Platform and continues as long as you use the Service. Clicking the button and entering your username means that you’ve officially “signed” the Terms. If you sign up for Platform on behalf of a company or other entity, you represent and warrant that you have the authority to accept these Terms on their behalf.
Account Management
You or Comtrade SI may terminate this Agreement at any time and for any reason by giving Notice to the other party. We may suspend our Service to you at any time, with or without reasonable cause. If we terminate your account without cause, we’ll refund a prorated portion of your monthly prepayment or reimburse you for unused email credits. We won’t refund or reimburse you if there’s cause, like a violation of these Terms or our acceptable use policy. Once terminated, we may permanently delete your account and all the data associated with it, including your emails from our Website. If you don’t log into your account for 12 (in words: twelve) or more months, we may treat your account as “inactive” and permanently delete the account and all the data associated with it.
Account and Password
You’re responsible for keeping your account name and password confidential. You’re also responsible for any account that you have access to, whether or not you authorized the use. You’ll immediately notify us of any unauthorized use of your accounts. We’re not responsible for any losses due to stolen or hacked passwords. We don’t have access to your current password, and for security reasons, we may only reset your password.
Account Disputes
We don’t know the inner workings of your organization or the nature of your personal relationships, and we don’t arbitrate disputes over who owns an account. You won’t request access to or information about an account that’s not yours, and you’ll resolve any account-related disputes directly with the other party. We decide who owns an account based on the contact information listed for that account.
Changes
We may change any of the Terms by posting revised Terms of Use on our official Website and/or by sending an email to the last email address you gave to us. Unless you terminate your account within 10 (in words: ten) days, the new Terms of use will be effective immediately and apply to any continued or new use of Platform. We may change the Website, the Service, or any features of the Platform at any time.
Payment
Postpaid
Use the Platform without limits and pay at the end of the month as much as you spend. This payment model is possible with the prior signing of the commercial Agreement with Comtrade SI.
Prepaid
Buy credit for prepayment spending according to your own needs. Any amount of credit is available to you. The time limit in which you have to use the loan is 12 (in words: twelve) months.
Prices
- All prices are exclusive of VAT. Payment of VAT is your obligation.
- Credit for consumption is granted after confirmation of prepayment.
- The payment period is 30 (in words: thirty) days.
- If the payment is not made after the expiration of the payment period, we reserve the right to close or temporarily block the account.
Refunds
We will give you a refund for a prepaid month if we stop providing our Services to you for a reason that is not laid out in these Terms of Use or for a reason, which can be considered as our fault. You will not be entitled to a refund from us under any other circumstances.
Rights
Proprietary Rights Owned by Us
You will respect our proprietary rights in the Website and the software used to provide Service (proprietary rights include patents, trademarks, service marks, trade secrets, and copyrights).
Proprietary Rights Owned by You
You represent and warrant that you either own or have permission to use all of the material in your Emails. You retain ownership of the materials that you upload to the Platform. We may use or disclose your materials only as described in these Terms or if it is in accordance with relevant regulations.
User obligations
The user is obligated:
- To comply with all regulations and data protection laws, electronic communications and privacy, applicable to countries to which you send any e-mail via Platform.
- To collect, store, use and transfer all data related to any individual in accordance with all applicable data protection regulations and laws. The user agrees that the Platform can receive and process data and send all received communication via e-mail to the User.
- And guarantees that e-mail addresses that have been delivered to Platform for sending newsletters are collected in a legal way and with the appropriate prior consent of all subscribers
- That if, in the past 12 months, he has not sent a newsletter to the list of subscribers which will be used in the future, he will send newsletters exclusively to e-mail addresses that are not older than 12 months, and will provide adequate proof in the form of the date of creation of the e- mail addresses or newsletter subscription dates.
- That he has read and accepted all general terms and conditions of Comtrade SI.
Data protection
Comtrade SI agrees not to disclose confidential information in any form to unauthorized third parties or to use confidential information for other purposes other than purpose of operating the Platform. Comtrade SI is obligated to keep all data that have access to, which according to legal regulations fall into the category of personal data, as a business secret and in accordance with relevant regulations.
Acceptable Use Policy
Forbidden content
Please do not use Platform to send anything offensive, to promote anything illegal, or to harass anyone. You may not send:
- Emails offering to sell illegal goods or services
- Emails that violate ANTI-SPAM Laws
- Pornography/sexually explicit content
- Emails addressed to minors.
- Escort and dating services
- Pharmaceutical products
- Multi-level marketing
- Affiliate marketing
- Credit repair and get out of debt opportunities
- Selling “Likes” or followers for a social media platform
- Advertising and/or offering any services, goods or products whose circulation is prohibited or restricted.
- Online trading, day trading tips, or stock market related content
- Daily horoscope reports
- Mortgages and loans
- Nutritional, herbal, and vitamin supplements
- Adult Entertainment/Novelty Items
- Real estate
- Services that support programmatically sending mail on behalf of third parties without creating or reviewing the content.
